Virtual Try-On Privacy Notice

This Virtual Try-On Privacy Notice (“VTO Privacy Notice”) applies to virtual try-on services (“VTO Services”) available on macys.com and in select Macy’s stores. VTO Services use augmented reality technology to allow you to submit either (i) an existing image from your computer or device or (ii) use the camera functionality in-store or on your device (collectively, “Image(s)”) from which Macy’s will virtually “apply” color to an Image of your face. Submitting an Image allows you to virtually try-on select beauty products. This VTO Privacy Notice describes Macy’s collection, use and disclosure of personal information through the VTO Services. Please Note: Macy’s may permit a third-party vendor (for example, a beauty brand) to provide virtual try-on services to Macy’s customers in store, however this VTO Privacy Notice will not apply to any third party’s virtual try-on services.

Consent

We collect your consent before we scan your face from the Images. Any scan is automatically deleted when you close out of the VTO Services.

Why We Collect & Use Information

• Images collected under this VTO Notice are used by Macy’s only to facilitate your use of the VTO Services. We delete the Images when you stop using the VTO Services either online by closing your web page or in store by closing the application. Macy’s uses the Images to show you, through the VTO Services, how products will look on you.

How Macy’s Collects Information

• Macy’s collect Images when you use the VTO Services through the processes described above.

• Macy’s collects activity information through Google Analytics imbedded into the VTO Services. For more information on Google’s information practices, please visit their privacy policy at https://policies.google.com/privacy?hl=en-US

• If you decide not to share your Image or consent to a scan of your face, you will not be able to use the VTO Services.

• VTO Services may not be available to users in certain states, such as Illinois. If you are a California resident and have questions about your California privacy rights please visit the Notice of Privacy Practices for Macy’s in-store and e-commerce services. You may choose to opt out of the sale of your personal information through the link titled “Do Not Sell My Personal Information” on macys.com. Please know that we do not sell any Images collected through the VTO Services.

How We Share Your Information

Macy’s partners with one or more third party vendors to provide the VTO Services. In doing so, we require each vendor to enter into written agreements requiring the vendors to not retain any Images and to maintain security controls to safeguard the virtual try-on technology.

Children’s Privacy

VTO Services require that a user be thirteen (13) years of age or older.

Macy’s expressly reserves the right to change this VTO Privacy Notice at any time.
