Item defective and looks used

So I ordered this as a gift and wanted to test it out before gifting. I tried different sets of batteries and it just would not work. The lever does still pull and the images spin but that's unrelated to the electrical issue. I could not exchange it as the item was no longer available. I will still gift it and let the person know of the defect so they're not met with the same disappoint as I was. It's still a unique item, but I was still very disappointed. Also to mention, the product has some marks around it which would indicate that it had been previously used and returned.
